On 23 January 2026, the Chief Judge of the Federal High Court (FHC or the Court), in exercise of the powers conferred under Order 57 of the Federal High Court (Civil Procedure) Rules 2019, issued the Federal High Court (Nigerian Electricity Supply Industry) Practice Directions, 2026 (the Practice Directions). The Practice Directions are aimed at ensuring the efficient and expeditious disposition of disputes arising within the Nigerian Electricity Supply Industry (NESI).
Aligned with existing legislative and institutional reforms within the power sector, the Practice Directions introduce enhanced case management tools and sector-specific measures, representing a necessary reform aimed at strengthening the institutional resolution of electricity sector disputes.
In this newsletter, we review the key provisions of Practice Directions, assess their likely impact on dispute resolution within NESI, flag potential implementation challenges, and share practical recommendations for industry stakeholders.
